1. ABOUT THESE TERMS

These Terms of Sale apply to purchases made through www.cuirasex.com (the “Site”).

The seller is CUiRASEX INTERNATIONAL LLC, a Wyoming limited liability company trading as CUiRASÉX (“CUiRASÉX”, “we”, “us” or “our”).

Our Shipping & Delivery Policy, Returns, Exchanges & Refunds Policy, Privacy Policy and Terms of Use form part of these Terms of Sale. If there is a conflict relating specifically to a purchase, these Terms of Sale will apply, subject always to any mandatory rights available under applicable consumer law.

Please read these Terms carefully before placing an order.

2. CUSTOMER ELIGIBILITY

You must be at least 18 years old, or the age of legal majority in your place of residence, and have the legal capacity to enter into a contract.

Products purchased through the Site are intended for personal use. We may refuse or cancel an order where we reasonably believe that it is being placed for unauthorized commercial resale, fraudulent activity or another unlawful purpose.

Nothing in these Terms prevents the lawful resale of a product already purchased by a customer where such a restriction would be prohibited by applicable law.

3. PRODUCT INFORMATION

We take reasonable care to ensure that product descriptions, photographs, dimensions, materials and prices are accurate.

Colours and surface details may appear differently depending on the screen or device used to view the Site. Measurements are approximate unless expressly stated otherwise.

Our handbags are individually handcrafted using natural leather and hand-finished components. Subtle variations in leather grain, colour, texture, stitching and hand-polished surfaces are characteristics of the materials and processes and do not necessarily constitute defects.

The principal materials used for each product are stated on its product page.

4. AVAILABILITY

The handbags currently offered on the Site are existing, ready-to-ship pieces available in limited quantities.

Adding an item to your shopping bag does not reserve it. Products remain available for purchase by other customers until checkout has been completed and the order has been accepted.

We reserve the right to correct inventory errors. If an item becomes unavailable after an order has been submitted, we will notify you and refund any payment received for that item.

We may apply reasonable purchase limits where necessary to protect product availability or prevent suspected unauthorized resale.

5. PLACING AND ACCEPTING AN ORDER

When you submit an order, you are making an offer to purchase the selected products in accordance with these Terms.

After submission, you will normally receive an automated order acknowledgement. This acknowledgement confirms that we have received your order but does not necessarily mean that the order has been accepted.

All orders are subject to:

  • Product availability

  • Payment authorization

  • Address and identity verification

  • Fraud and security screening

  • Compliance with applicable laws and shipping restrictions

A contract is formed when we send you a dispatch confirmation, unless applicable law provides otherwise.

We may refuse or cancel an order before dispatch if the product is unavailable, the payment cannot be authorized, the information provided is incomplete or inaccurate, the price contains an obvious error, or we reasonably suspect fraud or unlawful activity.

If payment has already been collected for an order that we cannot accept, the applicable amount will be refunded to the original payment method.

6. PRICES AND PAYMENT

Product prices are displayed in the currency selected or shown during checkout.

Shipping charges, applicable taxes collected by us and the total payable amount will be displayed before you submit the order. Destination-country import duties, taxes, customs brokerage charges and other government fees are not included unless expressly stated otherwise.

Available payment methods are displayed during checkout and may change from time to time.

By submitting payment information, you confirm that:

  • The information is complete and accurate

  • You are authorized to use the selected payment method

  • Sufficient funds or credit are available

  • The transaction complies with applicable law

Payment may be subject to authorization and fraud-prevention checks performed by us, Shopify, the payment provider or the card issuer.

If an obvious pricing error occurs, we may cancel the affected order and refund the payment. Where reasonably possible, we will give you the opportunity to place a new order at the correct price.

7. SHIPPING AND DELIVERY

Orders are dispatched from our fulfilment location in China.

Ready-to-ship orders are normally prepared and dispatched within three to five business days after payment and order verification.

Orders are normally shipped using EMS or another tracked international delivery service selected by CUiRASÉX according to the destination and service availability.

International delivery normally takes approximately 7 to 20 business days after dispatch. Processing and delivery times are estimates and are not guaranteed.

Delivery may be affected by customs clearance, public holidays, weather, transportation disruption, local postal operations or other circumstances outside our reasonable control.

Shipping charges are displayed during checkout. The available destinations, services and prices may change according to carrier availability.

A complete and accurate street address, recipient name, postal code and telephone number are required. We are unable to guarantee delivery to P.O. boxes, military addresses or freight-forwarding addresses unless approved in advance.

Please contact Customer Care immediately if delivery information requires correction. We cannot guarantee that an address can be changed once an order has entered processing or has been transferred to the carrier.

Risk of loss or damage remains with CUiRASÉX until the order is delivered to you or to a person identified by you to receive it, except where applicable law provides otherwise or you independently appoint a carrier not offered by us.

8. IMPORT DUTIES, TAXES AND CUSTOMS

Unless expressly stated otherwise during checkout, orders are shipped on a Delivery at Place basis.

The recipient is responsible for acting as the importer and for paying any import duties, taxes, customs brokerage charges or other government fees assessed by the destination country.

Customs rules and charges vary by country and may change without notice. We cannot predict or guarantee the amount that may be charged. Customers should consult the relevant customs authority before ordering if they require further information.

International orders must be declared accurately. We cannot reduce the declared purchase value, provide false information or describe a commercial order as a gift.

The customer must provide any identification number, tax number, authorization or documentation requested by the carrier or customs authority. Failure to do so may result in delay, additional charges or return of the parcel.

CUiRASÉX is not responsible for delays caused solely by customs authorities, although we will provide reasonable assistance with available shipment documentation.

9. ORDER CHANGES AND CANCELLATIONS

Please contact customercare@cuirasex.com immediately if you wish to change or cancel an order.

Because ready-to-ship orders may be processed quickly, we cannot guarantee that a change or cancellation will be possible.

If we accept a cancellation before dispatch, the applicable payment will be refunded to the original payment method.

Once an order has been dispatched, it must be handled under the return procedure below.

10. CHANGE-OF-MIND RETURNS

You may request a return by notifying us within 14 calendar days of delivery.

After notifying us, you must dispatch the authorized return within the following 14 calendar days.

To request a return, email customercare@cuirasex.com with your order number, the item being returned and the reason for the return.

If the request is accepted, we will provide:

  • A Return Authorization

  • The applicable return address

  • Shipping instructions

  • Customs-documentation instructions

Do not send an item back without authorization or to an address not provided for that specific return.

Returned items must be unused, uncarried and in their original condition. All original packaging, dust bags, protective materials, accessories, tags and accompanying documents must be included.

You may examine the product only as you reasonably would in a retail store. Where permitted by law, we may reduce the refund to reflect diminished value caused by handling beyond what was reasonably necessary to examine the product.

Authorization of a return does not guarantee a refund. Returned items will be inspected after arrival.

Nothing in this section limits any mandatory right of withdrawal or return available under applicable consumer law.

11. RETURN SHIPPING

For change-of-mind returns, the customer is responsible for return shipping costs.

Where available, we may provide a prepaid, tracked return label. Before issuing the label, we will disclose its actual cost. That cost will be deducted from the refund.

If we cannot provide a prepaid label for the customer’s location, we will specify an approved tracked shipping method. The customer must then arrange and pay for the return shipment directly.

Returns must use the method provided or approved by CUiRASÉX. Proof of acceptance and tracking are required. Signature confirmation or shipment protection may also be required depending on the destination and value.

Customers must retain their shipping receipt and tracking information until the refund has been completed.

We cannot reimburse a return service selected without our prior approval.

International return documentation must state the contents, value and reason for return accurately.

12. DAMAGED, FAULTY, INCOMPLETE OR INCORRECT ITEMS

Please contact customercare@cuirasex.com as soon as reasonably possible if an order arrives damaged, faulty, incomplete or different from the item ordered.

Please provide the order number and clear photographs of:

  • The item and reported issue

  • The outer shipping carton

  • The internal packaging

  • The shipping label

An unboxing video may be helpful but is not mandatory.

Please retain the item and all packaging while the claim is reviewed.

Where an item is confirmed to be damaged, faulty, incomplete or incorrect, CUiRASÉX will arrange the return or reimburse reasonable return shipping costs approved in advance.

Depending on the circumstances, product availability and applicable law, the appropriate remedy may include repair, replacement, price reduction or refund.

Nothing in these Terms excludes or limits statutory rights relating to goods that are faulty, misdescribed or otherwise non-conforming.

13. REFUNDS

We aim to inspect returned items within five business days of receipt.

Approved refunds will be issued to the original payment method. A bank or payment provider may require an additional five to ten business days to post the funds.

For an approved change-of-mind return, the refund will include the purchase price of the returned product, less the cost of any prepaid return label supplied by CUiRASÉX.

Original delivery charges are non-refundable except where reimbursement of the least expensive standard delivery service is required by applicable law.

For a confirmed damaged, faulty, incomplete or incorrect item, applicable standard shipping and approved return costs will be refunded or reimbursed in accordance with applicable law.

Import duties, taxes and customs charges paid directly to a government authority, carrier or customs broker are not collected by CUiRASÉX and cannot be refunded by us. Customers may be able to apply to the relevant authority for reimbursement.

Where permitted by applicable law, we may withhold a refund until we have received the returned item or the customer has provided acceptable evidence that it has been dispatched.

If a returned item does not meet the return conditions, we will contact the customer before determining the appropriate next step. Any reshipment costs may be charged to the customer where permitted by law.

14. EXCHANGES

We do not currently offer direct exchanges.

A customer wishing to select a different design must return the original item and place a new order. Product availability cannot be reserved while a return is being processed.

15. REFUSED AND UNCOLLECTED DELIVERIES

Refusing delivery, failing to collect a parcel or declining to pay applicable import charges does not constitute an authorized cancellation or return.

If a parcel is returned because delivery was refused, import charges were not paid, required customs information was not supplied, or the parcel was not collected, reasonable outbound shipping, return transportation, storage, customs and carrier charges may be deducted from the refund where permitted by applicable law.

A refund can be considered only after the parcel has been received at the address specified by CUiRASÉX and inspected.

16. LIABILITY

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence where applicable.

Nothing in these Terms excludes or restricts mandatory consumer rights.

To the fullest extent permitted by law, CUiRASÉX will not be responsible for losses that were not reasonably foreseeable when the contract was formed or for business losses arising from a purchase made for personal use.

Subject to liabilities that cannot legally be limited, our aggregate liability relating to a product will not exceed the amount paid for that product and its standard delivery.

17. EVENTS OUTSIDE OUR CONTROL

We will not be responsible for a delay or failure caused by circumstances outside our reasonable control, including natural disasters, severe weather, epidemic or pandemic restrictions, war, civil disturbance, government action, customs action, carrier interruption, transportation disruption, labour disputes or failure of telecommunications systems.

Where such an event occurs, we will take reasonable steps to reduce the effect and communicate any material delay.

This section does not remove any cancellation, refund or other right that must be provided under applicable law.

18. PERSONAL INFORMATION

Personal information provided during an order will be processed in accordance with our Privacy Policy.

Information may be shared with payment providers, carriers, customs brokers, fraud-prevention providers and other service providers where reasonably necessary to process payment, fulfil the order, arrange delivery or comply with legal obligations.

19. COMPLAINTS AND CUSTOMER CARE

Questions or complaints relating to an order should be sent to customercare@cuirasex.com.

Please include your name, order number and a clear description of the issue. We will make reasonable efforts to respond and resolve the matter promptly.

20. GOVERNING LAW AND CONSUMER RIGHTS

These Terms and contracts made under them are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles.

However, if you are a consumer residing outside Wyoming, nothing in these Terms deprives you of mandatory protections available under the laws of your place of residence.

Nothing in these Terms prevents a consumer from bringing proceedings in a court or using a dispute-resolution procedure available under mandatory applicable law.

21. CHANGES TO THESE TERMS

The version of the Terms in effect when an order is placed will normally apply to that order.

We may update these Terms from time to time. Changes will not apply retroactively to an existing order unless required by law or expressly agreed with the customer.

22. SEVERABILITY AND WAIVER

If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect.

A failure or delay by either party to exercise a right does not waive that right.

These Terms, together with the policies incorporated into them, constitute the agreement between CUiRASÉX and the customer concerning the purchase.
